Governing Law and Jurisdiction

These Terms of Service and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the internal laws of the State of Wyoming, United States without giving effect to any choice or conflict of law provision or rule.

You agree that any legal suit, action or proceeding arising out of or related to these Terms of Service or the Website shall be instituted exclusively in the federal or state courts located in the State of Wyoming and you hereby irrevocably submit to the personal jurisdiction and venue of such courts.

Japji LLC makes no representation that the materials, content or services published on the website are appropriate, legal or available for use in your specific residential area, state or country.

Accessing this website from locations where its contents may be illegal is strictly prohibited.

If you choose to access JAPJI.NEWS from any location worldwide, you do so entirely on your own initiative and at your own risk.You are solely and completely responsible for ensuring compliance with all applicable local, national and international laws, regulations and ordinances.

A. Sexually Explicit and Pornographic Material 

We maintain a strict zero-tolerance policy for explicit sexual content. Prohibited material includes but is not limited to:

1/ Pornography and Erotica: Visual depictions of explicit sexual acts, sexual intercourse or masturbation.

2/ Nudity: Graphic displays of genitals, pubic areas, or exposed female breasts, unless explicitly permitted in writing for authenticated educational, documentary or artistic contexts.

3/ Sexually Explicit Services: Content that promotes, facilitates, or sells escort services, prostitution, dominatrix services or commercial sexual exploitation.

4/ Non-Consensual Imagery: The sharing of sexually explicit, intimate or nude images or videos of another individual without their express and verifiable consent.

6/ Child Exploitation: Any material depicting, facilitating, or promoting the sexual exploitation or abuse of minors. Violations involving child exploitation will result in immediate termination and reporting to law enforcement.

B. Hateful Content and Hate Speech 

We do not tolerate content that promotes violence, incites hatred, or discriminates against individuals or groups. Prohibited material includes but is not limited to:

1/ Hate Speech: Content that attacks, demeans, dehumanizes, or vilifies individuals or groups based on protected characteristics. These characteristics include race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, age or veteran status.

2/ Incitement of Violence: Text, imagery, or audio that threatens, encourages or incites physical violence or harm against a specific person or group.

3/ Hate Symbols and Propaganda: The display, promotion or distribution of symbols, logos, slurs or flags historically associated with hate groups or systemic discrimination.

4/ Harassment and Bullying: Targeted abuse, stalking, doxxing or malicious intimidation directed at any individual.

Enforcement and Right to Moderate 

We reserve the right but do not assume the obligation to actively monitor user-generated content. To enforce these rules, we may take any of the following actions at our sole discretion:

1/ Content Removal: We may remove, delete or obscure any content that violates this policy or that we otherwise deem objectionable without prior notice.

3/ Account Restrictions: We may temporarily suspend or permanently terminate your account and block your access to the platform.

3/ Legal Action: We reserve the right to report illegal material or activities to relevant law enforcement agencies and regulatory bodies.

Reporting Violations

JAPJI.NEWS are for your personal and non-commercial use unless otherwise specified. You may not use this site for any other purpose, including any commercial purpose without JAPJI.NEWS’s express prior written consent.

You may not modify, copy, distribute, display, send, perform, reproduce, publish, license, create derivative works from, transfer or sell any information, content, software, products or services obtained from or otherwise connected to JAPJI.NEWS unless expressly permitted by these terms.

All content uploaded to NYUSU.NEWS must be entirely free of advertisements, promotional materials and commercial branding.

This restriction applies with exception including any logos or watermarks in the media player from the third-party media hosting companies. 

Failure to comply with this regulation constitutes a material breach of these Terms may result in the immediate suspension or termination of your channel.

JAPJI.NEWS may contain comment boxes, forums, bulletin board services, chat areas, message boards, news groups, communities, personal web pages, calendars, and/or other message or communication facilities designed to allow you to communicate with the Internet community or with a group (collectively, “Communications Services”).

You agree to use the Communication Services only to post, send and receive messages and content that are proper and related to the particular Communication Service. Users agree to adhere to this Terms of Services agreement when using JAPJI.NEWS Communication Services.When using the Communication Services, you agree that you will not post, send, submit, publish or transmit in connection with this site any material that:

01/ You do not have the right to post, including proprietary material of any third party, such as files containing software or other material protected by intellectual property laws (or by rights of privacy or publicity);

02/ Advocates illegal activity or discusses an intent to commit an illegal act;

07/ Harvests or otherwise collects information about others, including e-mail addresses without their consent;

08/ Violates any law or may be considered to violate any law;

09/ Impersonates or misrepresents your connection to any other entity or person or otherwise manipulates headers or identifiers to disguise the origin of the content;

10/ Falsifies or deletes any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is permissibly uploaded;

11/ Advertises any commercial endeavor (e.g., offering for sale products or services) or otherwise engages in any commercial activity (e.g., conducting raffles or contests, displaying sponsorship banners, and/or soliciting goods or services) except as may be specifically authorized on this site;

12/ Solicits funds, advertisers or sponsors;

13/ Includes programs that contain viruses, worms and/or Trojan horses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications;

14/ Disrupts the normal flow of dialogue, causes a screen to scroll faster than other users are able to type or otherwise act in a way which affects the ability of other people to engage in real time activities via this site;

15/ Includes MP3 format files;

16/ Amounts to a pyramid or other like scheme, including contests, chain letters and surveys;

17/ Disobeys any policy or regulations including any code of conduct or other guidelines, established from time to time regarding use of this site or any networks connected to this site; or

18/ Contains hyper-links to other sites that contain content that falls within the descriptions set forth above.

JAPJI LLC reserves the right to monitor use of this site to determine compliance with these Terms of Service, as well as the right to remove or refuse any information for any reason.

JAPJI LLC reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.

JAPJI LLC also reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in its sole discretion.

Materials uploaded to a Communication Service may be subject to posted limits on use, reproduction and/or dissemination and you are responsible for abiding by such limitations with respect to your submissions, including any downloaded materials.

Notwithstanding these rights, you remain solely responsible for the content of your submissions. You acknowledge and agree that neither JAPJI LLC nor any third party that provides Content to JAPJI.NEWS will assume or have any liability for any action or inaction by JAPJI LLC or such third party with respect to any submission.

JAPJI LLC cautions you against giving out any personally identifying information about yourself in any Communication Service. japji.NEWS does not control or endorse the content, messages or information found in any Communication Services, consequently JAPJI LLC specifically disclaims any liability with respect to the Communication Services and any actions resulting from your participation in any Communication Service.

Managers and hosts are not authorized JAPJI LLC spokespersons and their views do not necessarily reflect those of JAPJI LLC.

The material and content accessible from this site, and any other website owned, operated, licensed, or otherwise controlled by JAPJI LLC is the proprietary information of JAPJI LLC or the party that provided or licensed the Content to JAPJI.NEWS whereby such providing party retains all right, title and interest in the Content.

Accordingly, the Content may not be copied, distributed, republished, uploaded, posted or transmitted in any way without the prior written consent of JAPJI LLC, except that you may print out a copy of the Content solely for your personal use and you may re-post a single image and up to one hundred (100) words of continuous text from any article if such posting provides a right of attribution to JAPJI LLC and promotes the article on other websites including social media sites.  

In doing so, you may not remove or alter, or cause to be removed or altered, any copyright, trademark, trade name, service mark or any other proprietary notice or legend appearing on any of the Content. Modification or use of the Content except as expressly provided in these Terms of Service violates JAPJI LLC’s intellectual property rights.

Neither title nor intellectual property rights are transferred to you by access to this site.From time to time, the website will utilize various plugins or widgets to allow sharing of content via social media channels, email or other methods. Use of these plugins or widgets does not constitute any waiver of JAPJI LLC’s intellectual property rights.Such use is a limited license to republish the content on the approved social media channels, with full credit to the website.

Registered channels and contributors must host their uploaded content on an approved third-party media hosting service or a self-hosted device and provide a valid and direct link to JAPJI.NEWS during the submission or uploading process to ensure optimal service performance and user experience.

To maintain a consistent and professional aesthetic across JAPJI.NEWS, all contributors must adhere to the following Hero Image and Picture Lede requirements.

1/ Visual Clarity: All uploaded primary images must feature a clean, professional design free of clutter.

2/ No Text Overlays: You may not overlay titles, subtitles, captions or promotional text directly onto the image.

3/ Logo Restrictions: Logos are permitted on images only if they directly relate to the published story and do not violate public interest, copyright laws or community standards.

Except as otherwise provided in a separate written agreement between you and JAPJI LLC, you hereby grant JAPJI LLC a royalty-free, perpetual, irrevocable, worldwide, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, distribute, publicly perform, display and create derivative works from all content, remarks, suggestions, ideas, graphics or other information communicated through this site (collectively, the “Submission”).

JAPJI LLC may incorporate any Submission into other works in any media or technology now known or later developed. 

JAPJI LLC will not be required to treat any Submission as confidential and may utilize them for any business purpose (including, without limitation, products or advertising) without incurring liability for royalties or any other consideration. 

JAPJI LLC shall incur no liability for any similarities that may appear in future company operations. All personal information submitted through this site will be handled in accordance with the JAPJI.NEWS Privacy Policy.

By registering a channel, you agree that you are at least 18 years of age and possess either a formal background in journalism education or a minimum of 3years of professional reporting experience.

JAPJI LLC demands strict professionalism and journalistic integrity in every story published across our platform. 

By registering as a member or subscriber, you represent and warrant that you are at least 18 years of age.

Channels are permitted to utilize AI as a reporting aid on the condition that all AI-generated content maintains absolute factual integrity. The channel retains ultimate editorial responsibility as a gatekeeper of the public interest.

All content, features and functionality on JAPJI.NEWS are protected by international copyright, trademark, patent, trade secret and other intellectual property laws worldwide.

Trademarks

The trademarks, service marks, trade names, and logos displayed on this site including any distinctive logo are the registered and unregistered marks of JAPJI.NEWS or their respective international owners. 

Copyrighted Materials

All original website elements, including page headers, custom graphics, button icons, scripts, text, and source code, are owned exclusively by JAPJI LLC. You are strictly prohibited from copying, modifying, distributing, imitating or using any site content in whole or in part without prior written authorization.

Third-Party Intellectual Property

No License or Transfer of Rights

No Ownership: Nothing contained in these Terms transfers any right, title, or interest in any Trademarks or Copyrights to you.

No Implied Rights: No license or right to use any intellectual property is granted by implication, estoppel or otherwise, without the express written permission of JAPJI LLC or the applicable third-party owner.

Prohibited Misuse and International Liability

Any unauthorized use or misuse of the Trademarks, Copyrights, or content on this site is strictly prohibited. Violations may result in severe civil and criminal penalties under applicable international laws and local jurisdictions. 

Violating these property rights is illegal and may result in legal action.

JAPJI LLC expeditiously responds to valid notices of copyright infringement that comply with applicable statutory requirements. If you believe your copyrighted work has been infringed upon, you may submit a formal takedown notice to JAPJI.NEWS via email.

To be processed, your notice must include all six enumerated elements below. Upon receipt of a legally sufficient notice, JAPJI LLC will promptly remove or disable access to the allegedly infringing material and make a good-faith effort to notify the affected content owner or administrator. 

Required Elements of a Takedown Notice

1/ Authorized Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2/ Identification of Copyrighted Work: Clear identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works.

3/ Identification of Infringing Material: Identification of the material that is claimed to be infringing, along with information reasonably sufficient to permit the service provider to locate the material (e.g., specific URLs).

4/ Contact Information: Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and an electronic mail address.

5/ Statement of Good Faith: A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

6/ Statement of Accuracy: A statement that the information in the notification is accurate, and under penalty of perjury that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

* Be aware that a notice must contain all six points for JAPJI LLC to take action. All other notices will be ignored.

The material and content accessible from this site, and any other website owned, operated, licensed or otherwise Channel subscriptions are billed on a non-recurring 30-day basis.

JAPJI.NEWS does not automatically extend or renew subscriptions as content quality across individual channels may fluctuate. Subscriptions must be manually renewed by the user.

All purchases are non-refundable.JAPJI LLC reserves the right to issue promotional credits at its sole discretion in place of monetary refunds.

When a user purchases a 30-days paid subscription to a channel, the gross subscription price is subject to a revenue-sharing allocation.The channel operator shall receive 92.5% of the net subscription revenue which is calculated after the deduction of all processing fees, transaction charges and other applicable levies imposed by banks, credit card companies and third-party payment gateways. 

JAPJI llcreserves the right at its sole discretion to modify this splitting percentage at any time and without prior notice. 

Furthermore, JAPJI LLC maintains the absolute right to adjust, increase or decrease the revenue split for any individual channel without any obligation to provide justification or prior explanation.

JAPJI LLC may distribute free promotional credits to readers. As a contributor, you accept that members can use these credits to subscribe to your channel and that standard revenue-splitting policies do not apply to credit-based subscriptions.

Under most circumstances, pay-subscriptions is non-refundable. At its sole discretion, JAPJI LLC may provide compensation to subscribers or members in the form of free subscription credits.

You will indemnify and hold JAPJI LLC, its subsidiaries, affiliates, licensors, content providers, service providers, employees, agents, officers, directors, and contractors (the “Indemnified Parties”) harmless from any breach of these Terms and Conditions by you, including any use of Content other than as expressly authorized in these Terms of Service.

You agree that the Indemnified Parties will have no liability in connection with any such breach or unauthorized use, and you agree to indemnify any and all resulting loss, damages, judgments, awards, costs, expenses and attorneys’ fees of the Indemnified Parties in connection therewith.

You will also indemnify and hold the Indemnified Parties harmless from and against any claims brought by third parties arising out of your use of the information accessed from this site.

JAPJI LLC is provided on an “as is” and “as available” basis without any warranties of any kind  either express or implied.In no case shall the Company, our directors, officers, employees or affiliates be liable for any injury, loss, claim or any direct, indirect, incidental, punitive, special or consequential damages of any kind arising from your use of the service or website.

While JAPJI LLC makes every effort to ensure the accuracy of the information on this website, it is developed strictly for informational purposes. Your use of this site and its content is entirely at your own risk.
